1. About these Terms
These Terms govern Flyover, operated by Matthew Adams, an individual trading as Flyover in Scotland, United Kingdom. Contact [email protected]. A public business correspondence address is awaiting confirmation and must be added before public launch.
Read these Terms and the Privacy Policy before using Flyover. New account registration asks you to acknowledge these Terms and confirm that you are at least 16. The Privacy Policy is a notice about data processing; agreeing to these Terms does not constitute blanket consent to personal or health-data processing. This draft does not require existing users to accept new terms retrospectively.
2. What Flyover provides
Flyover is a browser application for importing GPX/FIT activity files, exploring 3D routes, analysing recorded activity information, creating cinematic route films and saving personal Memories with stories, captions and photographs.
Guests can import, explore, analyse and export on their device. Cloud saves and the saved Memories library require an active signed-in account. Original files are processed in the browser; cloud saving uploads processed activity information and selected content. Map and weather requests can still leave your device without a cloud save, as explained in the Privacy Policy.
Browser, device and format support affect rendering and export. Keep your own originals and copies of important content; Flyover is not an archival backup service. This does not limit any duty we owe you under applicable law.
3. Eligibility and your account
You must be at least 16 and able to enter into these Terms under the law applicable to you. Provide accurate account information, use an email address you control, complete verification when requested and keep your authentication credentials secure. Do not share an account to bypass access controls. Tell us promptly if you suspect unauthorised access.
You are responsible for content and activity you authorise through your account. You are not automatically liable for every unauthorised use regardless of fault or any failure by Flyover.
4. Acceptable use
Use Flyover lawfully and respect other people. You must not:
- Supply unlawful content or use the service for illegal activities, harassment or abuse.
- Violate privacy, disclose another person’s private location or information unlawfully, or upload content without the necessary rights and permissions.
- Try to access another user’s account, private activities, photographs or data.
- Exploit vulnerabilities, circumvent security or access controls, introduce malicious content, or disrupt or overload the service or its providers.
- Remove required third-party attribution or use provider content contrary to its applicable licence.
Report suspected security problems privately to [email protected]. Please avoid accessing anyone else’s data while investigating.
5. Your content and our intellectual property
You retain ownership of your activities, photographs, stories, Memories and other original content. You give Matthew Adams, operating Flyover, a limited, non-exclusive licence to host, copy, process, display to you and synchronise that content only as needed to provide and protect the service you request, including film creation and the use of service providers for those purposes.
This licence does not allow us to market Flyover using your private content. It ends when the content is deleted, except for limited processing necessary to complete deletion, manage backups or meet applicable legal requirements as described in the Privacy Policy. You must have the rights needed to grant the licence.
Flyover’s original application code, design, branding and proprietary materials remain the property of Matthew Adams or their respective owners. Third-party software, maps, terrain, imagery and graphics retain their own rights and licences. These Terms do not transfer ownership of those materials to you.
6. Downloaded films and third-party rights
You may download and share films you create, for personal or commercial purposes to the extent of your own rights and the rights Flyover can grant. We do not claim ownership of your original contributions to a film. You must respect the rights of people and content shown in it.
Map, imagery and terrain licences also apply. Preserve legible credits in exported films and include required accompanying notices when sharing. OpenFreeMap permits commercial use and requires map attribution in video, including © OpenMapTiles and Data from OpenStreetMap. OpenStreetMap data is licensed under the Open Database Licence; a rendered film is distinct from redistribution of the underlying database, which may carry additional obligations. Terrain has dataset-specific credits and licence requirements.
Satellite imagery rights remain under review. Availability of Esri World Imagery through a public endpoint is not proof of permission to redistribute it commercially or in downloadable video. Flyover does not grant unrestricted rights to Esri or contributor imagery. Before publishing or commercially distributing films containing it, the applicable service agreement and contributor permissions must be confirmed. The operator must resolve production and video redistribution rights before public launch, or disable/replace that layer.
Flyover cannot grant rights it does not hold. Provider credits and licences remain applicable outside Flyover, including when a platform crops or overlays a film.
7. Accuracy and intended use
Flyover is a creative visualisation and storytelling tool. GPS recordings, elevations, gradients, fitness calculations, map geometry and generated route representations may be incomplete or inaccurate. Visual smoothing and presentation can differ from recorded measurements.
Historical weather is labelled as estimated or modelled where applicable. Station-based information is not necessarily a direct observation at your position or exact recorded time.
Do not rely on Flyover for safety-critical navigation, medical diagnosis or advice, emergency guidance or guaranteed geographic accuracy. Fitness analysis is informational and is not clinical assessment. Check important information independently and seek appropriate professional advice when needed.
8. Availability and changes to the service
We aim to provide a reliable service, but cannot guarantee uninterrupted or error-free availability. Maintenance, browser/device limitations, network failures and third-party map, authentication, hosting or weather services may affect features. We will take reasonable care and skill where required by law.
We may make reasonable changes to improve, secure or maintain Flyover. For a material withdrawal or change affecting saved content, we will give reasonable notice and an opportunity to retain available copies where practicable, except where urgent security or legal reasons prevent it. Mandatory consumer rights remain unaffected.
9. Suspension and termination
We may proportionately restrict, suspend or close an account for a serious or repeated breach of these Terms, unlawful activity, or a material security risk. Where reasonable and appropriate, we will explain the reason and provide notice and an opportunity to remedy the issue or challenge a mistake by contacting us.
Immediate action may be necessary to protect users or comply with law. Restrictions will be no broader or longer than reasonably necessary. We will respect applicable consumer rights and data protection obligations when handling content after closure.
10. Closing your account
You can use Account → Delete Account to close your account and delete associated cloud activities, routes, Memories, Moments, photographs and account records. You must confirm your password and type DELETE. Deletion is permanent; download any films and retain any originals you need first.
If cleanup is interrupted, retry in the application or contact [email protected]. The account is closed to new saves once deletion begins. Unrelated guest work and copies on other devices or external platforms are not automatically erased. Limited deletion receipts, shared weather caches, backups and security/legal records are addressed in the Privacy Policy; no instant deletion from every backup is promised.
11. Current price and future plans
The functionality currently offered is free. Flyover plans a freemium model with optional annual subscriptions, but paid subscriptions, Stripe payment processing, recurring charges and subscription cancellation features are not currently offered by this application. Creating an account does not authorise a future charge.
Any paid offering will require separate, clear pricing and billing information and your express agreement at that time. Applicable consumer cancellation, digital-content and other statutory rights will be addressed before payments are enabled.
12. Responsibility and liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited. Your mandatory consumer rights and remedies, including applicable rights concerning reasonable care and skill, digital content and damage to your device or other digital content, remain intact.
Subject to those protections, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable, or losses caused by misuse where we are not at fault. Nothing here makes you responsible for our own failures.
If you use Flyover for business purposes, to the extent lawful we exclude indirect or consequential business losses, including lost profits, revenue, business opportunity or goodwill. This does not reduce protections you have when acting as a consumer. No blanket exclusion of liability for data loss or a zero-value liability cap is imposed.
13. Governing law and resolving concerns
These Terms are governed by Scottish law. If you are a consumer elsewhere, you retain any mandatory protections of the law that applies to you. You may bring proceedings in any court available to you under applicable consumer law; these Terms do not require every consumer to litigate in Scotland.
Please contact [email protected] about concerns or complaints so that we can try to resolve them. This does not prevent you from exercising legal rights.
14. Changes and enquiries
Revisions will show a new effective date. We will give appropriate notice of material contractual changes, through the application or an account email where suitable, and seek agreement when required. Changes will not remove accrued rights or authorise new charges without agreement. If you do not wish to continue under a material change, you can stop using Flyover and close your account, subject to your existing rights.
